What is Theft of Services?
The legal term for a crime which is committed when a person obtains valuable services — as opposed to goods — by deception, force, threat or other unlawful means, i.e., without lawfully compensating the provider for these services.
In the past, in the park we have had a problem with theft of services and the board will be trying to get better control of this during the 2024 year.
Ways the board will be working on this.
A. Looking for stickers/hang tags at the common grounds, pools, bathhouses and trash dumpster. Those that do not have properly marked vehicles will be asked to return to their lot. ATV’s without identification of block and lot visible to security and/or board members and/or park employees will be asked to return to their lot. ATV’s can be marked with temporary markings while in the park such as a piece of cardboard with lot and block zip tied to it, a paper plate with written numbers etc. We do understand some members don’t want their ATV identifiable while in town and that is fine but while on park roads it must have some form of identification on them. We will be working with the county sheriff to give out trespass warnings and tickets to control vehicles/persons who are in the park and at the common grounds or using the roads without permission.
B. Looking for theft of water. This includes but is NOT limited to the following:
1. Not paying an assessment and found to be using water. This includes using an unlocked spigot on your property or using a neighbor’s water with or without permission.
2. If the neighbor knows your using the water from their lot, the property owner will be held responsible for theft of services.
3. More than 1 camper connected to a spigot. If you pay 1 assessment this allows you to connect 1 camper to water. If you connect a 2nd camper you will be charged with theft of services.
4. Alternating pumping of campers. 1 assessment allows 1 camper to be pumped. You may not alternate campers on your lot if you have more than 1 camper.
5. If you need water/pumping on a second camper you must either pay a 2nd assessment for that camper or you have the ability to pay a per night rental fee of $30.
C. Looking for use of the trash dumpster for anything other than regular camp trash. You may not bring your household trash to the park to dispose of. You may not throw anything other than regular camper trash in the dumpster. We have a scrap metal pile by the park shop if you need to discard metal.
D. Looking for participation in park activities if your assessment has not been paid.
Theft of services is a criminal offense and will be reported to the Sharp County Sheriff’s office for prosecution.
Theft of services spends POA money that is paid by members in good standing to be able to enjoy the amenities of the park.

No assessment payments will be accepted without signing the Registration Form accepting the updated rules and regulations.
A Non-paying POA member cannot be a guest of a paying POA memberIn the 2023 November board meeting it was voted that we will have POA window stickers for the members and hanging guest passes for their guests. There will also be hanging visitor passes that are good for specific dates.

HANGING GUEST PASSES: each paid assessment will get 4 hanging guest passes. They must be displayed on the rear view mirror of your guests vehicle while the vehicle is in the park. The POA member will be responsible for keeping up with their guest passes.
HANGING VISITOR PASSES: if you need a temporary pass for a visitor, you may obtain a hanging visitor pass in the office. You will need to know the exact dates they will be in the park. These will be dated for that time and they must hang on the rear view mirror at all times while the vehicle is in the park.
ATV: your ATV MUST be marked with your lot and block. It doesn't have to be permanent. We are aware that some don't want theirs marked if they go into town. However, to be on the roads in the park they must be marked. The roads belong to the corporation of River Bend and not the POA.
Any vehicles that are not marked will be identified and a board member and/or security when available will ask the person driving to return to the POA lot they own or are visiting. This will help ensure paid members and their guests are the ones in the park and using amenities. Non paid owners will not receive stickers/passes.
To obtain stickers/passes you will need to have on file in the park office a copy of your recorded deed or notarized contract, a 2024 Registration Form and have paid your annual maintenance assessment. ONLY a person listed on the deed or contract will be able to receive the stickers/passes. You will also be required to show ID to the office personnel in order to obtain your stickers/passes. This is to protect our park and all those who own property in the park.

The Annual Assessment will be $825 effective 01/01/2024. If you pay on or before February 1st, you will receive a $50 adjustment making the Annual Assessment $775. For any assessment paid after May 1st, there will be a $25 Late Fee.
As always, there are Online Processing Fees and Credit Card Fees applied as necessary depending on your choice of payment. To avoid any extra fees, you may pay with Cash, Check or Money Order that can be brought or mailed to the office. If you have requested a USPS mailed invoice, there will be a $1 Mailing Fee.

The 2023 Park Season closing date will be Monday, December 4, 2023 (weather permitting).
On January 21, 2023, the board voted to NOT allow River Bend Park lots to be leased or B&B rented. Several POA members were asked their opinion during this discussion. The board understands that you own the lot, but it is very concerning to everyone (POA members and the board) in allowing a different person/family to stay each weekend/year since most times there is no due diligence done (no background checks, the lessee/B&B renter has no vested interest in the park, etc). The same applies to lots being sold as to due diligence, but not every seller feels the same. River Bend Park is a family oriented place, and we want to keep our children as safe as we can.
The 2023 Park Season opening date will be Friday, March 17, 2023.
You now have the option to donate through CashApp if you wish too. This is for Activities ONLY!! No other park payments should be sent here. If you do make a donation, please make sure to specify what it is for, i.e. Candy for Halloween, money for blow-ups for Holiday weekends, etc.

If you have a Maintenance issue, DO NOT post it on Facebook in any group. River Bend Property Owners Association, Inc is the ONLY GROUP monitored by the park office and admins of the page. It is NOT MONITORED 24/7. To report a maintenance problem, you can either email the Park Manager at rbpark.manager@gmail.com or call / text them at 870.897.7275. Include your lot & block and a description of the problem. If possible, include a video or picture as this may help in determining the fix. If the phone is not answered, LEAVE A VOICE MAIL!! If you do not leave a voice mail, you will not get a call back.
A maintenance issue is anything outside the office. Water leaks, faucets not turning off, tree fell in the road, marking water lines before digging, bath house issues, any pumping issue AFTER the pump list has been posted, etc.
If you have a non-maintenance issue, you can either email the Office Assistant at rbpark.office@gmail.com or call / text them at 870.819.7757. Include your lot & block and a description of the issue. The office is open on Friday from 10am to 2pm. If you need to come into the office on a different day, you will need to call and make an appointment. The office is closed on Sunday, Tuesday and Wednesday, the phone will not be answered.
A non-maintenance issue is anything inside the office. Questions about your account, annual assessments, bringing a filed deed in to register, purchasing gate cards / fobs, pumping requests PRIOR to the list being published in the Facebook group, etc.
At the August 20, 2022 POA meeting, it was voted on by POA members to have POA meetings on the 3rd Saturday of every month in person at the park from March to November. For December, January and February, a meeting place will be determined and published.
At the August 20, 2022 POA meeting, it was voted on by POA members to move the Board and POA meetings to the park and be in person. The Board meeting will be zoomed so that POA members can watch, but no Board member will use Zoom unless it is an extreme emergency or work.
At the August 20, 2022 POA meeting, it was voted on by POA members to do the following for anyone that is breaking a rule, i. e. loud music at their lot after 11:00pm, loud music on a motorized vehicle driving around after 11:00pm (SxS, 4-wheeler, golf cart, etc.), speeding, etc.
At the August 20, 2022 POA meeting, it was voted on by POA members to change Quiet Time to be 11:00pm to 7:00am. This is the final time this matter will be addressed. This is effective as of 08/20/2022.

"There is a lot that has happened that everybody has been a part of. I’m glad that we were all here for that. These were a lot of things that I wanted to get done when I started here. And you guys have worked together, we’ve all worked together to get these things accomplished.
I look forward to seeing what this next board does, from the sidelines. Effective at the adjournment of this meeting, I am resigning as a board member of River Bend Park. I want to thank you property owners for the opportunity to serve. I want to thank you board members for allowing me to be the president. And to my children, Jared, Will and Kinsley, I love you all."

Starting TOMORROW (not today) you can request a Holiday Gate Code. Request will ONLY be accepted from June 22, 2022 to June 29, 2022. Any received before or after those dates will be rejected. They only way a request will be accepted is through the website Holiday Gate Code form at https://riverbendparkhardyar.com/gate-code-form. DO NOT email, call or text the office or park manager phones. If your request does not come from the website, it will be rejected. The gate code will be active from July 1, 2022 at 12 noon to July 4, 2022 at 12 midnight.
REMINDER: POA members voted in the August 14, 2021 POA meeting that there be a park standardized plate that has to be visible on all motorized vehicles such as ATV, UTV, SxS, golf carts, dirt bikes, etc with the POA members primary lot and block. The Rules & Regulations state that all motorized vehicles such as ATV, UTV, SxS, golf carts, dirt bikes, etc have lot and block on them, but there are no set standards. It was decided that the standardization will be a regular sized license plate, lettering needs to be at least 2” or more which is DOT standard sizing, lettering needs to be a contrasting color from the plate and it should be placed in the most visible spot on the vehicle. POA members that purchased license plates from Lisa Harrell or plates that have the standard sizing/lettering will be grandfathered in. All motorized vehicles such as ATV, UTV, SxS, golf carts, dirt bikes, etc are required to have a visible plate/label by July 1, 2022.
To accommodate any guest of a POA member that wishes to use their motorized vehicles such as ATV, UTV, SxS, golf carts, dirt bikes, etc in the park, you will be able to purchase a guest flag that denotes you are allowed to ride while in the park. You can purchase a guest flag for $20 for the season. Or if you turn the guest flag back in the same weekend you purchased it, you will receive $10 back.
If you have AT&T as your service provider, you may or may not have received the automated response when texting in your pump request. They have changed something with their authenticating process. This has caused some POA members who texted last year not to be able to text at all this year, you will get a Mailer Daemon error about authenticating. For those that do make it through to the pump list, there are instances where the automated response doesn't get sent to you. If you don't get the automated response after sending a text, send an email. You need to make sure you get the automated response. I have been telling new POA members to email if they use AT&T, don't even try using text. Remember when emailing, put your lot and block in the correct format in the body of the email, do not use the subject line.
Block 9 gate is not working right now. A wire has come out of the circuit board.
Today to next Wednesday, May 25th, 2022, is the ONLY time you can request a Holiday Gate Code. You HAVE to go to https://riverbendparkhardyar.com/gate-code-form and fill out the form. This is the ONLY way that a Holiday Gate Code request will be accepted. Do not email or call the office asking for a code.

PUMPING REQUESTS: PLEASE READ CAREFULLY AND IN ENTIRETY.
In order to get on the pump list, you can send a text or email to rbpark.pumping@gmail.com to be put on the MONDAY pumping list. When sending the text/email, ONLY send your lot and block. It needs to be in 000-00 number format, with LOT listed FIRST, then the block. It HAS to be a 3 digit lot, a dash, then a 2 digit block with no spaces. Lot and block numbers must be in this format with no other wording, or your request will be rejected. For example, if you are lot 1 in block 1, you would send 001-01. Lot 29 in block 10 would be 029-10. Make sure you use the number 0 and not the letter O. DO NOT forward your previous texts/emails. If you are emailing your request, DO NOT use the subject line, put your lot and block in the body of the email. If you have more than one lot, send a separate text/email for each lot and wait at least 1 minute before sending the next one. Your pump request MUST be sent via text/email to rbpark.pumping@gmail.com. DO NOT text it to the office phone number. DO NOT text it to the park managers phone number. DO NOT send it to the office email address. It WILL NOT be accepted. You need to make sure you send your lot and block in the correct format. You will get a rejection text/email if it is not in the correct format. Make sure you watch for this and be sure to check your Spam/Junk folder. RBP is not responsible for any cellular carrier issues, or failure to send in a corrected request after a rejection has been sent. If your request comes in after 9pm, you will be put on the next Monday's pump list.
Again, the format is very important so that your request will not be rejected by the system. No extra information other than the numeric format of your lot and block should be sent. Remember for emails, DO NOT use the subject line, put your lot and block in the body of the email.
You do not need to wait until Sunday to send in your request. You can start as early as Tuesday morning. If you have bad cellular service at the park, and you know you are coming, send your request from home.
In order to get pumped, 1) your annual assessments need to be up to date, 2) your lot and block need to be visible on your camper/lot so the crew can find you, 3) YOU MUST HAVE A CLEAR PATH TO YOUR TANKS. This means no bicycles, lawn mowers, hanging floats, wood, etc in front of your drain valves and from the road to your camper.
There will be a $1 mailing fee added to any invoice that a POA member asks to be USPS mailed.
The water will not be turned on until at least March 16, 2022. The reason is because it will be freezing for 2 or 3 nights in a row beginning March 11th or March 12th. We don't want to chance it and have water pipes busting right before opening.
2022 Season opening day is Friday, March 18th.
RESOLUTION

We, the undersigned, being all the Directors of River Bend Park POA, organized and existing under the laws of Arkansas, and having its principal place of business at PO Box 337, Hardy, Arkansas 72542 (the “Corporation”), hereby certify that the following is a true and correct copy of a resolution duly adopted at a meeting of the Directors of the Corporation duly held and convened on January 12, 2022, at which a quorum of the Board of Directors was present and voting throughout, and that such resolution has not been modified, rescinded or revoked, and is at a present in full force and effect.
Therefore, it is resolved:
That a Governing / Covenants Committee shall help assist the board in matters of rule compliance and violation enforcement. The committee shall have 2 Directors (non-officer) to oversee the meetings. The committee shall include 5 POA non-board members. The committee shall review the complaints that have been reported in a meeting with proper recording of minutes. The committee shall collect any evidence in support of the complaint, to include park video surveillance and witness statements, if available depending on where the complaint occurred. The committee will determine a consistent discipline for minor offenses, and address all major complaints with a reasonable recommendation; i.e. suspension of services, restitution from the offender if damage has occurred, etc. The committee will present to the Directors overseeing the committee their recommendations, which will then be presented to the entire Board. The Board can offer another recommendation, or agree with the committee recommendation. The committee shall keep a 3 year record of offenses and evidence.
Committee members assigned to the Governing / Covenants Committee will be approved by the board. A member will be removed after 3 consecutive missed meetings.
PLEASE NOTE: If you owe past invoices, but only pay your 2022 Assessments, your services 𝗪𝗜𝗟𝗟 𝗡𝗢𝗧 be turned on! ALL invoices need to be paid before any services are turned on.
Invoices have been emailed and snail mailed for the 2022 Assessments and any remaining open balances. If you received an email, but prefer a paper bill mailed to you, please let the office know at rbpark.office@gmail.com or 870.819.7757.
Please fill out the 2022 Registration Form at https://riverbendparkhardyar.com/docs-%2F-forms. You can fill it out online and email it, or print a copy. You can turn it into the office by mailing to PO Box 337, Hardy, AR 72543, emailing it to rbpark.office@gmail.com or by dropping it off at the office in the dropbox.
The 2022 Assessments have been emailed out. The snail mail ones have also been sent. You will notice there is a 1% Online Processing Fee. This is a fee we have to recoup from the POA because the park is being charged this. This was talked about at a board meeting, the POA meeting in November 2021 and was posted on FaceBook and on the River Bend Park web page.
As everyone is aware, yearly assessments are due on February 1st of every year, unless paying in 2 installments. We understand that a lot of people prefer to pay in March when the water is turned back on. With that in mind, if the yearly assessment has not been paid by Sunday at midnight (in full or half) after opening day, you are considered a member NOT in good standing. Members that are not in good standing are only allowed 1 active gate card/fob. Any extra cards/fobs that you have will be deactivated until the annual assessment (in full or half) has been paid.
You will need to go to https://riverbendparkhardyar.com/primary-card%2Ffob to let us know which card/fob you prefer to be your primary one. If you do not fill this out, one will be picked for you and all others deactivated.
The block 5 gate keeps losing cellular connection. Please use block 9 gate.
There are campers illegally parked on the hill. There is no lot and block on them, no other marking to identify them, the park manager has not given permission to be parked there. The office has no way to contact them. The owner has 30 days to move the camper or get a parking pass from the office.
The office will be open on Saturday's from 1pm to 3pm. The office phone will be answered during normal business hours. If you need help, you can call the Park Manager phone at 870.897.7275 or the office phone at 870.819.7757.
The closing date for this season will be Monday, December 6, 2021. That is of course weather permitting. Both water and park power will be turned off on this day. All bath houses will be locked.
Beginning January 2022, there will be a 1% QuickBooks Reimbursement Fee added to all invoices. This will apply to POA members who pay their invoices by Online Checking or Savings accounts. If a POA member decides to pay by credit card, the 3% credit card fee and the $0.25 flat fee will still apply, but the 1% fee will be removed. If a POA member pays by cash or check, the 1% fee will be removed.
It was decided that POA members in good standing can park on the hill with a VALID Parking Permit from the office until the weekend before the Memorial Day Holiday. If campers are not moved from the hill by the Sunday prior to Memorial Day weekend, they will be charged $50 per week, up to $500. Then the camper will be towed at the owners expense.
Effective October 3rd, 2021, the pump board will be removed from the office. All POA members will need to email or text in their pump request. The pump request will need to be completed by 9pm Sunday night. The email or text HAS to be sent to rbpark.pumping@gmail.com. Pump requests sent to any other email address or phone number will NOT be accepted. Voice mails and phone calls will NOT be accepted. It is the POA members responsibility to ensure they send the request in on time. Do not wait until Sunday afternoon to send your request. If you do not receive a confirmation back, try again. Multiple requests from the same phone number or email will only receive one confirmation.
Quiet Time hours have been changed to 12am to 7am. Camp site radios, TVs, vehicle radios, etc. should be kept at a respectable volume during quiet time hours. All vehicles, ATV’s, SxS, golf carts, etc. riding around on park roads during quiet time hours should be respectful of other property owners.
